摘 要

兒童的利益體現了國家的利益。兒童福利是社會保障體系的重要內容，兒童福利制度建設的完善，關乎社會穩定和發展，同時也體現了社會的文明與進步。

新中國建立 60 多年來，經濟高速發展，為我國兒童福利事業奠定了堅實的經濟基礎。特別是 2010 年國務院辦公廳《關于加強孤兒保障工作的意見》的出臺，業界學者將這一年，稱為“中國兒童福利元年”,我國兒童福利事業迎來了嶄新的發展階段，同時也面臨著抉擇和挑戰。當前，我國正處于社會轉型發展的重要歷史時期，在此背景下，兒童的問題、家庭的問題日益激化，凸顯。而我國現有兒童福利發展還面臨著許多問題，存在許多不足，最突出的表現在兒童福利對象還不夠廣、兒童福利服務內容有待豐富、水平有待提高，普惠性有待增強，我國兒童福利制度亟需進行變革和創新。我國兒童福利應該選擇怎樣的科學發展之路，是我們迫切需要解決的現實問題。

本文除引言、結語外，共五部分。

第一部分引言，介紹了本文的選題的背景、意義，研究方法，以及國內理論學界關于我國兒童福利的研究現狀以及部分國外兒童福利的狀況，分析了本文的重點和創新點。

第二部分圍繞兒童和兒童福利的內涵進行了闡釋?！皟和笔潜容^特殊的社會群體，具有“基礎性”、“發展性”、“未來性”三種社會本質屬性。受社會發展因素的影響，特殊的兒童群體越來越被社會所關注，對當今社會兒童分類的闡釋說明是兒童福利框架構建的一個重要方面?！皟和＠辈糠种饕ㄟ^社會學界普遍認同的“廣義兒童福利”和“狹義兒童福利”概念做進一步闡釋，結合前文關于“兒童”特性的分析，概括出當前社會需要的“兒童福利”的真正內涵。

第三部分分別從我國兒童福利法律體系、管理機構、社會保障制度、特殊兒童福利現狀四部分對我國兒童福利現狀進行系統梳理，力求客觀、完整呈現出我國兒童福利制度建設的脈絡。

第四部分針對現有兒童福利制度基本現狀和當前突出的社會矛盾，通過舉例、數據分析，歸納出我國兒童福利領域存在的三方面問題：孤兒基礎保障能力不足、其他特殊兒童保障缺口嚴重、侵犯兒童權利事件頻發，這部分作者運用歸納法將兒童侵害事件進行了分類概括，這些問題暴露出我國兒童福利領域的短板，引人深思。

第五部分分析當前兒童福利領域出現這些問題的原因：“兒童利益最大化”理念未得到有效落實，國家主體責任意識不夠、法律體系建設不完善、缺乏規范高效的兒童福利行政管理體系、兒童福利保障制度建設不健全、兒童福利服務水平偏低。比照當前我國兒童福利現實領域中的三個問題，結合我國現有的兒童福利現狀，逐一提出問題產生的原因，并且對每一條原因都做了具體的分析和例證。

第六部分提出我國兒童福利制度今后的發展建議：首先明確今后我國兒童福利建設發展方向；其次針對第五部分的原因分析逐一提出有針對性的對策，加快兒童福利法制化建設進程，要加快兒童福利立法，建立兒童案件的司法處理機制；建立統一的兒童福利管理行政體系，要形成一體權威的兒童福利行政管理機構和兒童案件司法審理機構，同時要加大財政投入的力度和建立豐富全面的兒童福利信息網絡；健全兒童福利保障體系，要健全社會保障制度，建立家庭監督和支持機制、完善兒童安置體系；提升兒童福利服務水平，提升福利機構服務水平，引進社會資源發展兒童福利慈善事業。這些有針對性的對策有針對、有側重，是實實在在根植于問題分析提出的，為我國今后兒童福利的發展指明了方向。

第七部分結語。從作者自身感受談起，對論文整體構架進行了簡明扼要的概括，再次拋出中心論點，同時對我國兒童福利發展寄予希望。

Abstract

The interests of the children reflects the national interest. Child Welfare is animportant part of the social security system. The institutional improvement of ChildWelfare promotes the social stability and development. It is also a symbol of socialcivilization and progress.Since the 60th anniversary of China's founding, the rapiddevelopment of national economy laid a solid foundation of China's Child Welfare.

Especially the year 2010, General Office of the State Council published Opinions onstrengthening Orphan security. The academics referred to as “the First Year of ChildWelfare of China”.The career of Child Welfare ushered in a new stage of development,but also facing choices and challenges. At present, China is experiencing an importanthistorical time of social transformation. In this context, problems of children andfamilies are intensified. The development of Child welfare in China is still facing a lotof problems and insufficient. The most prominent problem is that we need a widerrange of objects, richer and higher-levels of content and an improved universality. TheChild Welfare system is in an urgent need of innovations. What kind of scientific wayof developing China should choose is the real problem which must be solved.

This thesis contains seven parts including introduction and conclusion.

Chapter one is introduction, mainly discuss the background, significance,research methods of selected topic and the research status of China's Child Welfaresituation given by domestic theoretical circles and also some status of foreign ChildWelfare. It also introduces the innovation and the key point of this thesis.

The second chapter explains the connotation of children and Child Welfare.

Children are a special social group. It has the social natures of fundamentality,expansibility and futurity. Special children's group is getting more and moreattentions because of social development. The classification of children in today'ssociety indicates an important part of Child Welfare frame construction. The partChild Welfare will be further discussed in both general and narrow sense. Withcombination of children's characteristics analysis, Chapter two gives the connotationof Child Welfare that really asked by today's society.

Four parts for China's Child Welfare will be systematically discussed in the thirdchapter: law system, management mechanism, social security system, special ChildWelfare situation. It targets to the basic status of system and outstanding phenomenonin current society, aiming to give an objective and integrated structure of ChildWelfare system construction.

By analyzing the basic status of Child Welfare system and social contradictions,Chapter four concludes existing problems of three aspects through illustrating anddata analyzing: insufficient basic secure ability for orphan, a severe shortage forspecial children and frequent occurred violation of children's rights. Especiallygeneralized and analyzed the Child abuse event through the method of induction.

Problems mentioned above showed the weakness of China's Child Welfare, andmaking people think.

Chapter five analyses the reasons for these problems in the field of Child Welfareat present: ineffectively implemented of children benefit maximization concept,insufficient responsibility consciousness of the main body of the country, theimperfect legal system construction, the lack of effective children welfareadministration management system, unsound child welfare security systemconstruction and low level of children welfare service. According to the threeproblems mentioned in Chapter four and the status of China's Child Welfare, thischapter brings up reasons with analysis and illustrations detail by detail.

The sixth chapter puts forward suggestions for further development of ChildWelfare system in China. Firstly, to make clear of the direction for the development ofChild Welfare construction and give targeted countermeasures for chapter five.

Secondly, to accelerate the legal system construction process of Child Welfare, tospeed up the legislation and establish a mechanism for the judicial process. Thirdly, toestablish a unified management system of Child Welfare, authoritative administrationsand judicial review institutions are in desperate need. Meanwhile, government needsto increase financial investment and comprehensive information network. Fourthly,Government needs to perfect the security system of Child Welfare and to improvesound society welfare, and to improve the family supervision, supporting mechanismand the resettlement system. Fifthly, enhance the service level of Child Welfare.

Utilizing social resources develop philanthropy. Those countermeasures are made inview of practically problems, showing the direction of development of children'swelfare in China.

The seventh chapter is conclusion. Combining self experience of author, thischapter will give brief summarize for the structure of this thesis, emphasize the centerargument and at the same time looking forward to the development of child welfare inour country.
