摘要

在社會經濟快速發展、社會分工進一步細化、城市化進程加快的中國當下，多種因素的交織帶來了房屋租賃業的快速發展。房屋租賃作為一種非常有效的資源配置方式，在社會上發揮者重要的調控功能，意義重大。其實中國的房屋租賃現象不僅可以追溯至遠古的奴隸社會，而且從那時起一直是在不間斷地發展著并延續至今。而宋朝作為商業經濟比較發達的朝代，商業的繁榮和城市的發展、國家政策變化的影響及人們觀念的轉變，帶來了宋代房屋租賃業的發展，是房屋租賃業發展的一個典型時期。所以，本文的研究就著眼于宋代。

本文結合中國法律史學科的學科特點，采用法學和史學相結合的方法進行。

反映到文章的內容上，表現為文章的 “宋代房屋租賃的當事人”“宋代房屋租賃發達的原因及歷史評價”等內容和史學結合得比較緊密。而“宋代房屋租賃當事人的權利和義務”“宋代房屋租賃的糾紛解決機制”“宋代官府對房屋租賃的干預”“宋代房屋租賃的借鑒意義”等部分內容則和法學關聯性更強一點。

之前關于宋代房屋租賃的相關課題研究，無論是學術論文還是期刊論文，多出自歷史院系專家、學者之手，從法律角度來研究這一課題的尚比較少。所以，本文在吸收歷史院系專家、學者的研究成果同時，對上面所述的四部分從法律角度進行了研究。特別是針對對宋代房屋租賃評價中的消極部分，結合現實情況，從有益于當今房屋租賃發展的角度出發，提出了相關的建議，這也是本文的創新點所在。

Abstract

In the rapid development of society and economy, the social division of labor furtherrefinement, to speed up the process of urbanization in China today, many interwoven factorsbrought about by the rapid development of housing rental industry. Rental housing as a veryeffective allocation of resources, play an important regulatory function in society, significance. Infact, the rental housing phenomenon in China not only can be traced back to the ancient slavesociety, and since then has been in the uninterrupted development and continue up to now. And theSong Dynasty as the commercial economy is relatively developed, affect the transformationof development, commercial prosperity and the city's national policy changes and the concept ofpeople, bring about the development of the Song Dynasty housing rental industry, is atypical period for the development of housing rental industry. Therefore, this study will focus onthe song dynasty.

In this paper, combined with the subject characteristics subject China legal history, lawand history of using the method of combination of.
