摘 要
憲法解釋程序，是指憲法解釋主體進行憲法解釋的方式、方法、步驟和順序的總稱。一般包括憲法解釋的對象、方法，憲法解釋的提起、受理和審查以及解釋的效力等。憲法解釋的真正有效運作，有賴于合理的憲法解釋程序的支持。作為一種防范和實施手段，憲法解釋程序的設計應高于一般立法程序且低于憲法的制定或修改程序。憲法解釋程序植根于各國的憲法審查制度和司法程序中，不同法域的憲政框架與司法傳統決定了它的多樣性。它與憲法審查制度的類型相聯系， 大致可以分為抽象型的解釋程序與案件型的解釋程序。
我國憲法解釋程序機制目前的現狀和問題是：理論研究的主要內容集中在憲法解釋的本體論和方法論兩個方面，其中又以關于憲法解釋概念的方面的研究最多，涉及憲法解釋程序的研究較少也不夠深入；立法上，現行憲法只規定了由全國人大常委會行使解釋憲法的職權，但是憲法和立法法中并沒有關于哪些主體可以向釋憲機關提起憲法解釋請求的規定，也沒有規定應當依照何種程序進行憲法解釋活動，可以說憲法解釋程序在我國的法律體系中是空白的；在實踐中，因為沒有關于憲法解釋程序的具體規定，加之我國憲法解釋的表現形式并沒有統一的規范標準，所以我國目前是否存在真正的憲法解釋是存在爭議的；思想意識上，憲法意識淡薄也是阻礙我國憲法解釋程序機制發展的一個原因，這是因為如果忽略了憲法的權威性，意識不到憲法對維護自身權利的作用，那么在合法權益受到侵害時就不會想到這種救濟方式，也就沒有了解釋憲法的需求，憲法解釋程序機制就沒有存在的價值，更不會有所發展。
完善憲法解釋程序機制是憲法發展的必要條件；是我國法治建設的題中之義；是我國處在社會轉型期的客觀需求；是推動憲法實施的關鍵因素。我國憲法解釋程序機制的完善應該從以下幾個方面來進行：制定憲法解釋程序的專門法律，以法律的形式明確規定啟動憲法解釋程序的請求主體、憲法解釋請求的受理程序、憲法解釋案的起草與審議程序、憲法解釋的通過與效力以及憲法解釋案的形式和公布；在憲法解釋程序機制中引進憲法專家參與制度；學術界要加強對憲法解釋程序制度的理論研究；增強全社會的憲法意識，來推動憲法解釋程序機制的發展。

Abstract
Constitutional interpretation procedure is the process of interpreting the Constitution,which includes Constitutional interpretation methods, procedures and sequence. It includesthe objects and methods of Constitutional interpretation, the filed of Constitutionalinterpretation, accept and examine and explain effectiveness and so on. The real effectivefunctioning of Constitutional interpretation, depends on the support of the reasonable programof the Constitution interpretation. As a preventative and implementation methods, theprogram design interpretation of the Constitution should be more strict than the generallegislative process but less strict than the program of making or modify Constitution.
Interpretation of the Constitution is rooted in the national program of Constitutional reviewand judicial proceedings, the different constitutional framework and judicial traditions indifferent jurisdictions determine its diversity. According to system for the review ofconstitutionality, it can be divided into abstract type of interpretation and case-basedinterpretation.
The current situation and problems of China's interpretation of the Constitutionprocedures mechanisms are: the main content of theoretical research focused on theConstitutional interpretation of the ontological and methodological aspects, among which themost studied aspects of Constitutional interpretation on the concept, the research programinvolving Constitutional interpretation is not enough depth; On legislation, the currentConstitution only provides the execution of power of constitutional interpretation for the NPCStanding Committee, but neither the Constitution nor the legislative law mention that whichsubject can request a Constitutional interpretation of the provisions, there is no provisionwhich process should be conducted in accordance with constitutional interpretation activities,you can say that the program was constitutional interpretation blank in our legal system; inpractice, because there is no specific provision on constitutional interpretation program,coupled with our interpretation of the Constitution and there is no uniform manifestationstandards, so that our country if there is a true interpretation of the Constitution iscontroversial; the ideology, poor awareness of the Constitution is one of the reasons hinderour interpretation of the Constitution's procedural mechanism for the development, because ifyou ignore the constitutional authority, unaware the constitutional role to safeguard theirrights, then the legitimate rights and interests have been infringed would not expect such aremedy, there is no need to interpret the Constitution, the constitutional mechanism to explainthe program there would be no value, but will not be developed.
Interpretation of the Constitution mechanisms is a necessary condition to improve thedevelopment of the Constitution;it is the meaning of the construction of the rule of law; it isthe objective demand in the period of social transition in China;it is a key factor in promotingthe implementation of the Constitution. Perfection of the Constitution should be interpretedprocedural mechanism for the following aspects: constitution interpreter special laws, in theform of clearly defined legal body of the request to start a program of constitutionalinterpretation, constitutional interpretation request acceptance procedures, interpretation ofthe Constitution Drafting case and review process, in the form of constitutional interpretationand validity and interpretation of the Constitution and published case; in constitutionalinterpretation program mechanisms involved in the introduction of constitutional expertsystem; once again, to strengthen the academic theory of constitutional interpretationprocedure system; enhance the whole society Constitution awareness program to promote thedevelopment of constitutional interpretation mechanisms.
