中文摘要

法律建設對于保障與促進經濟發展的重要性，是毋庸置疑的。而在國際經貿合作過程中，建設并完善相關的法律制度亦是一項舉足輕重的大工程。當前，世界重要經濟體以及發達國家都把阿盟作為國際經貿合作的重心，同時也將與阿盟的合作作為沖破金融危機困局的關鍵抉擇。我國為了應對美國的“亞太再平衡戰略”,同時也為了加強與亞非拉新興市場的經貿合作，積極地推進“西進戰略”,將促進中阿經貿合作納入到新絲綢之路經濟帶建設的藍圖之中。因此，近年來我國十分重視對中阿經貿合作的保障與發展。目前，中阿經貿合作發展得如火如荼，然而這當中相關法律制度的建設也逐步暴露出一些問題與不足，若不能及時加以完善，很可能會給中阿經貿合作的未來發展造成不良影響。鑒于此，本文以保障中阿經貿合作的相關法律制度作為研究選題，重點探討中阿經貿合作中相關保障性法律制度的現狀及其存在的問題，并借鑒國際上相關經濟合作法律制度建設經驗，提出完善中阿經貿合作相關法律制度的對策和建議。

根據選題，文章除引言和結語外，共分為四個部分進行論述：

第一部分，阿盟及其對外貿易法律制度基本情況。對阿盟及阿盟自由貿易區的基本情況與歷史發展進程以及阿盟主要成員國的對外貿易法律制度建設情況進行簡要介紹。

第二部分，中阿經貿合作及法律制度建設現狀。簡要介紹中阿經貿合作發展現狀和中阿經貿合作相關法律制度的現狀。并進一步對中阿經貿合作法律制度存在的問題進行了分析。

第三部分，國際經貿合作法律制度建設經驗與探索成果。先介紹了典型的區域經濟合作法律制度建設經驗，又以與中阿合作有諸多相似之處的中非合作為借鑒，介紹了中非合作中法律合作相關探索的成果，以期為中阿經貿合作法律制度的建立與完善提供借鑒與啟發。

第四部分，中阿經貿合作相關法律制度的完善。從完善國內立法、加強雙邊法律合作以及借鑒國際條約，創新爭端解決機制等方面提出完善建議。

Abstract

The importance of legal construction is indisputable to protect and promote economicdevelopment. And in the process of international economic and trade cooperation, building andperfecting the relevant legal system construction is also a very important big project. Sinceentering new century, the developed countries and important economies are the development andthe league of Arab states （Arab league） the country's economic and trade relations, as the focus ofinternational economic and trade cooperation strategy and break through the financial crisisdilemma choice. In response to the negative impact of the Asia-Pacific rebalancing strategy,actively implement the strategy of the west in China, and central Asia, west Asia, southeast Asia,South Asia, Latin America, Africa, Russia and other emerging market economic and tradecooperation. Among them, the new silk road economic belt is one of the three schemes to the westof China strategy. Therefore, in recent years our country attaches great importance to theprotection and development of bilateral economic and trade cooperation. At present, the bilateraleconomic and trade cooperation development in full swing, however, the relevant legal systemconstruction of gradually exposed some problems and deficiencies, if not be perfected in time, arelikely to adverse impact on the future development of bilateral economic and trade cooperation. Inview of this, this article in order to ensure the China-Arab economic cooperation and trade relatedlegal system as the research subject, the paper mainly discusses the China-Arab economiccooperation and trade in the related protection legal system present situation and problems, andusing the experience of international economic cooperation related legal system construction, andputs forward some countermeasures to perfect the relevant legal system of bilateral economic andtrade cooperation and Suggestions.

According to the selected topic, the article besides the introduction and conclusion, is dividedinto four parts to discuss:

The first part is about the basic situation of the Arab league and its legal system of foreigntrade. Of the Arab league and the league of Arab states free trade area and the process of historicaldevelopment and the basic situation of the Arab league leading members of a brief introduction onthe construction of legal system of foreign trade.

The second part is about China-Arab economic cooperation and trade and the presentsituation of legal system construction. Briefly introduce the current situation of the developmentof bilateral economic and trade cooperation and bilateral economic and trade cooperation betweenthe present situation of the related legal system. And it analyzed further problems in China-Arabeconomic cooperation and trade law system.

The third part is about the international economic and trade cooperation and legal systemconstruction experience and exploration results. First introduces the typical regional economiccooperation of the legal system construction experience, and with the China-Arab cooperationwith many similarities in China-Africa cooperation for reference, this paper introduces the lawrelated to explore cooperation in China-Africa cooperation, so as to the establishment andperfection of legal system of bilateral economic and trade cooperation to provide reference andinspiration.

The fourth part, perfect the related legal system of China-Arab economic cooperation andtrade. From the domestic legislation, strengthen bilateral cooperation, and draw lessons frominternational treaties, innovation of dispute settlement mechanism, improving Suggestions, etc.
